That is the intent but an insurer's narrow interpretation can and often leads to a declination. This exclusion has been litigated ad nauseum leaving courts across the country struggling to deal with the scope of this language.

I haven't been in the claims game since I managed a team in NJ years ago. This was always an issue. We twisted it every way possible for logical adjustment solutions as it caused so many problems and misunderstandings. I suppose I shouldn't be surprised that it is still a major issue but I can't help but be surprised that it has never been effectively addressed. Could it be an issue that the "litigation fees collectors" can always count on to "stay around" forever?
 
BTIS has 10,000 E&O implemented to their policy. But the policy itself doesn't include completed work. It should be added as endorsement.
