I would post my opinions about certain products, but as I learned that is a lawsuit waiting to happen.. Keep digging you will find all the information you need...

You can post this without getting sued:

What do you think the potential liability is when you sell the most limited products to the sickest people?

Then we get to something I call "selective amnesia." That's when you explain the product properly yet your client gets slammed with bills.

They can:

A) Go BK
B) Hire an attorney to go after you or your E&O

If you have an ethical client they'll know what they bought and know you gave them a proper presentation. If not, let me know how the trial goes.

Talking to a GA for specialty life & health products. They have a few limited benefit medical plans that are guaranteed issue. They also market some GTL products.

AIM is supposedly issued by AMLI in most states and GTL in the others.

We started discussing AIM and he told me they do not allow their agents to market AIM on the same website as their products. They also considered refusing to offer their products to any agent who sells AIM but decided it would be impossible to police.

And then he dropped this bombshell.

GTL was unaware their name was attached to the hospital indemnity product. The only thing they insure is the accident benefit. They do NOT issue the "base" plan.

Their attorneys are furiously looking into this.

Imagine that . . .

A few years back they claimed to be underwritten by Chesapeake and had their logo on the brochures. I forwarded it to Chesapeake and one of their lawyers called me.

Seems AIM was in talks with Chesapeake but nothing was ever authorized. All of a sudden the Chesapeake info came off the brochures and literally a day later another carrier's logo was there.

Concerning HIPPA - I can't see where certain AIM plans wouldn't comply since certain features of those plans are underwritten and serviced by an actual insurance company as health insurance.

Just curious . . .

It makes no difference if or whom the underwriting carrier is.

Limited, defined benefit plans do NOT qualify as "HIPAA compliant". They are NOT creditable (or as AIM says "credible") coverage.

You tend to be knowledgeable in certain areas. Perhaps you could point me towards documentation that would sustain your statement. Or - please show me where to find information that precludes AIM from being HIPPA compliant and utilized as creditable coverage.

I can't seem to find any documentation that would disqualify them as being HIPPA compliant.

Just curious . . .

US Code, Title 29, Chapter 18, Subchapter I, Subtitle B, part 7, Subpart C, §1181:

(c) Rules relating to crediting previous coverage
(1) “Creditable coverage” defined
For purposes of this part, the term “creditable coverage” means, with respect to an individual, coverage of the individual under any of the following:
(A) A group health plan.
(B) Health insurance coverage.
(C) Part A or part B of title XVIII of the Social Security Act [42 U.S.C. 1395c et seq.; 1395j et seq.].
(D) Title XIX of the Social Security Act [42 U.S.C. 1396 et seq.], other than coverage consisting solely of benefits under section 1928 [42 U.S.C. 1396s].
(E) Chapter 55 of title 10.
(F) A medical care program of the Indian Health Service or of a tribal organization.
(G) A State health benefits risk pool.
(H) A health plan offered under chapter 89 of title 5.
(I) A public health plan (as defined in regulations).
(J) A health benefit plan under section 2504 (e) of title 22.
Such term does not include coverage consisting solely of coverage of excepted benefits (as defined in section 1191b (c) of this title).


And then the referenced 1191b (c):

(c) Excepted benefits
For purposes of this part, the term “excepted benefits” means benefits under one or more (or any combination thereof) of the following:
(1) Benefits not subject to requirements
(A) Coverage only for accident, or disability income insurance, or any combination thereof.
(B) Coverage issued as a supplement to liability insurance.
(C) Liability insurance, including general liability insurance and automobile liability insurance.
(D) Workers’ compensation or similar insurance.
(E) Automobile medical payment insurance.
(F) Credit-only insurance.
(G) Coverage for on-site medical clinics.
(H) Other similar insurance coverage, specified in regulations, under which benefits for medical care are secondary or incidental to other insurance benefits.
(2) Benefits not subject to requirements if offered separately
(A) Limited scope dental or vision benefits.
(B) Benefits for long-term care, nursing home care, home health care, community-based care, or any combination thereof.
(C) Such other similar, limited benefits as are specified in regulations.
(3) Benefits not subject to requirements if offered as independent, noncoordinated benefits
(A) Coverage only for a specified disease or illness.
(B) Hospital indemnity or other fixed indemnity insurance.
(4) Benefits not subject to requirements if offered as separate insurance policy
Medicare supplemental health insurance (as defined under section 1395ss (g)(1) of title 42), coverage supplemental to the coverage provided under chapter 55 of title 10, and similar supplemental coverage provided to coverage under a group health plan.
