Bodily Injury Coverage in NJ?

Need advice. My friend bought a a car and went to a local insurance agency to insure it. He was involved in an accident and the other person put a claim for bodily injury. He got a call from the State of NJ saying his policy does not have bodily injury coverage. He did not know the insurance agency had placed his policy with the State of NJ assigned risk even though he has 0 points or violations. He is now being sued by the other party. He knows nothing about insurance, shouldn't the agent that sold him the policy be held responsible? What can he do?
