I know the new commissions are capped for street agents at 400/200.
But...what can the agencies pay? Can they choose anything lower then that (say 360/180 or 340/170...etc)? I know that they cannot pay above 400/200, but what about paying lower then that for overrides.
I was told by someone that there will be a commission structure set forth by CMS that set the amount under the 400/200 they can pay off of.
Anyone hear anything different?

They can pay less than the $400/200. They just can't pay more. May companies are paying less, Pyramid, Humana, Wellcare, {in many counties}. I asked one FMO if the one paying less than $400 would have to step up and they never answered me.
United Healthcare may have come out with an updated commission schedule(with lower commissions), but the latest one I've printed out is dated 11-15-08. It lists commissions in just about all states on HMO, PPO, and Dual SNP as 450/225.

I don't know if they have put out a new grid yet, but, I got an email from them saying that they were forced to go the $400/200 maximum.
Coventry has been paying me $ 225/250 on my replacement business so far, I was informed that is was being capped at $ 200. Looks like I'll be getting some charge backs.

Yes... I have the same question. The problem is that CMS issued the edict for "writing agent", and those of us that signed a direct GA contract have not been told whether or not we will be paid at the "writing agent" level, or if we will get any overrides. Since I work alone and have no downline, I assume I won't get an override.
I am at "level 4" with Coventry, and they have never explained to me what that entails. Guess I will find out next week. Other carrier contracts say "GA", but no provision for override in the commission schedules.
All the carriers and FMOs are silent on this issue. First one to break silence will get the door prize.

To be truly independent, an agent should not be dependent on a government bureaucrat for contracts or commissions.
I have a downline throught the agecy I am at, and I am curious to know if we can pay whatever we want under the 400/200 or if there will be a substructure to follow. Or, if the override will be decent enough to pay 400/200 and still provide leads.
I guess we will have to wait and see...

I'm concerned about that other half for new enrollees that is to paid in the future. That would be an easy cut for the companies to make. Just not pay us money that we haven't gotten yet. That's much easier than a chargeback.
I've already taken the attitude that if I get that money, it's a bonus.
So here you are...a self-employed agent sweating out if you will get paid, are getting paid, or suffer chargebacks because of the capriciousness of some bureaucratic decision...usually 3-5 people.(who incidentally get paid on time and generously with our taxpayer money!) (sarcastic}
The main problem I have with all of this is my contracts are with the various carriers not with CMS.
