I have a small group that has W-2 employees that are 100% commissioned sales reps. They don't track their hours, the reps need to hit certain sales targets to remain employed. They have two sales level tiers that are calculated on a quarterly basis.

Can they base benefit eligiblity on hitting the sales figures? They only want to offer benefits to the top tier level. My carriers have told me they base it on hours and will only go off what we relay to them. Any insight as I am hitting a dead end?
