Do you always make the insured the owner of the policy?

Do you do that without discussing that with the client?

One of my client couples are getting divorced. She would love to have the policy, but he is the owner, it was not covered in the divorce decree, and she did not think to pursue it.

Whoever's holding the checkbook, typically. If I'm writing a married couple, I usually have them as owner/insured on their individual policies.

If your client lives in a community property state and the premiums for the policy were paid with marital assets I would run that by the divorce attorney.

Slushie's right, although every attorney has the clients do a complete inventory list in the proceedings, so if the divorce is still "in progress" she should simply bring it up. Something sounds a bit fishy, though.
