Humana I don't know but Anthem they are valid waivers.

I would think Medicare coverage would be a valid waiver in all 50 states. HIPAA?

In the end, it is partly valid. Small group has a base participation requirement of 75% with an absolute floor of 50%. In the case of this group, they had 9 employees, three valid spousal waivers and two Medicare waivers.

Although 100% of eligibles would enroll, they did not meet participation with Humana, because of the 50% floor.

Too bad, had to go with Anthem!
