Pregnancy May Soon Be a Q.L.E. in New York.

I'm confused. Doesn't federal trump state? How can NY passing pregnancy from a state standpoint be recognised as a QLE for the Federal Marketplace?

Federal trumps state if the law is "better".

Example: Federal law does not require the birthday rule for GI on Medicare. However some states have it. Its a "better" law for the insured.

In this case, NY is getting the Feds and Insurance companies to pay for pregos. Instead of the state paying for pregos. (Pregos ALWAYS get coverage, one way or another). Sounds like a brilliant plan to me. I always like it when I get someone else to pay for my laws....
 
In TX, pregnancy has ALWAYS been an immediate event for Medicaid enrollment.

Assuming thats true in other states, why are the legislators even doing this? Pregnancy is covered and the birth is an SEP.

Am I missing something?
