Since Part D did not go into effect until 1/1/2006, can I assume the max monthly penalty for a person would be 96 months. (8 years *12)?

If you were eligible on 1.01.06, and, didn't enroll before 5.15.06, and, now enrolled 1.01.15, you would have a 8 years + 6 month penalty.

If you're talking about someone who is enrolling in AEP, their effective date will be 01/01/2015, so it will be 9 years x 12 months = 108%
 
DS wouldn't that be 8 + 7 months? June through Dec is 7 months.

Unic they didn't start counting the penalty in 2006 until oep was over.

I figured it was similar to ACA where they gave them 3 months, but if you aren't enrolled, they backdate the penalty. Well, that will save one of my clients $1.75/month.
