Appointment Setter?

Paying for a kept appointment has nothing to do with a sale, so insurance departments shouldn't have a problem with it.

It is no different than Netquote selling you a lead.

All you are purchasing is a solid lead from the telemarketer.

If the compensation is based on selling the policy, then you are in trouble.
 
I highly encourage you to run the idea past your state department of insurance. Every state is different. I know here in Texas the practice you describe pushes the spirit of insurance licensing to the wall. In Texas no one may be paid a commission without a current insurance license. By putting the caveat of "kept appointment" on your payment structure you could have changed your payments from a Telemarketing fee to a commission.

It will not hurt you to call your state department of insurance or verify that your TM person has an active insurance license. If they are licensed, I do not see any problems.

I know what the letter of the law states in TX, but I don't think they do much to enforce it. I started out working for broker that had a call center of 30+ reps on the phone selling health insurance. None licensed. Every one was paid 7% annual premium. There was one licensed agent in the office for a few months than she left and they were ghost writing under an agent none of us had ever met. A few of us left and reported this to DOI.

As far as I know nothing negative ever happened to them from the complaints.

Chumps has actually applied, the goats are checking his references as we speak.
 
If this is the route you want to take you'd be better off paying them for their referrals, instead of having them make calls for you. Even if the DOI says it's allowed, the conversations that these telemarketers would be having with your prospects would probably make you cringe.
