Couple Legally Separated

I always was under the impression that if you are legally separated that if you apply for a policy on your own you won't qualify for a premium tax credit.

This agent told me it qualifies you for a SEP and if they financially qualify they will get a premium tax credit.

Legally separated is the same as divorced. Neither triggers an SEP per se.

If the divorce causes one spouse to lose coverage, the rules that apply to losing coverage come into play. Divorce by itself does not trigger an SEP.
 
I would check to see how the separation decree reads. I had a divorce a few months ago that actually specified that all joint properties were awarded to the wife, final and no future payments to either, and that neither had a health insurance policy that was offered to the other. It gave my client the ability to apply separately with only his income and get a sizable tax credit.

We also had to submit that paperwork to the Marketplace.
