Looking for others thoughts....

Client was divorced in January 2016.

2014 Combined MAGI and 8b was $600K
2015 Combined MAGI and 8b was $211K
2016 Single will be $500K due to a large Cap Gains hit prior to divorce.

BUT...her monthly income now is under the 85K. (No tears, she's got plenty in investments, just not touching it)

Does she qualify for an appeal? Thoughts?

My thinking is she qualifies due the divorce and income drop. But then when she files 2016, even though the money was moved, she's out of luck and needs to pay the max IRMAA.

Anybody have 2 cents on this one?

I would go ahead and fill out a life changing event form and see what happens.
