IRS Rules for HSA/HRA/FSA 2014 Eff. Date Plans

This affects plans that begin or when they renew after 1/1/2014.

On September 13, 2013, the IRS issued Notice 2013-54: http://www.irs.gov/pub/irs-drop/n-13-54.pdf relating to the Affordable Care Act providing additional guidance for certain employer reimbursement plans such as Health Reimbursement Arrangements (HRAs), Flexible Spending Accounts (FSAs) and Employee Assistance Plans (EAPs).

Any current FSA or HRA offering reimbursement for individually-owned insurance premiums will be required to drop this option at renewal in 2014. Any FSA offering employer benefit credits will need to address the employer contribution offered (there are limitations) and ensure group health insurance is offered in addition to a Health FSA.

Plans that are POP for group benefits or the standard voluntary offerings are not affected by this ruling.
