The DOI is mostly worthless, but would not hurt to file a complaint with them. Also shows good faith on your part.

Scary - we have lots of clients with them unfortunately. I agree about the DOI filing but I would suggest it to your client, not come from you necessarily.
 
The agent is not the wronged party, so yes, it was supposed to be implied that the client file the grievance.

The agent needs to be pro-active and side with his client, especially on something to ridiculously blatant. The best way to fight a potential lawsuit directed at you and/or an E&O claim, is to do everything you can to appease the client . . . as long as they are on the right side of the argument.

Agreed. He could probably even call his RSM to let them know he is having an issue with the client and the claim, if he hasn't already done so. He can even tell them the client and the doc are going to complain to the DOI to see if that does anything.
