In TN they could not enter into that sort of contract without being 18. The age 16 is in the insurance statues.. not the general statues concerning the age of majority. Even though you had to give the kid the money back, you should have had reason for action against the mother. She had no right to destroy the bike as it was not hers.

We did have those same thoughts but got what turned out to be excellent advice that we followed from the attorney.

He asked us if we really wanted to go after a nutbag who actually smashed this motorcycle up and shoveled it out of her truck into our parking lot in a million pieces. She was off the scale crazy.

The attorney also pointed out that she had two husbands who had committed sucide (at least on paper). The son got arrested a year later for breaking into a retired couple's mobile home and brutally murdering both of them.

No one even misses that $8,000 enough to deal with that level of crazy.
